Kansas City, MO — The family of a nursing home resident who died after a violent altercation with another resident at a Kansas City facility has filed a negligence lawsuit, alleging the facility failed to protect him and address longstanding safety issues.

The suit was filed Feb. 17 in Jackson County Circuit Court by the family of Darriyun Webb, 50, seeking damages in excess of $75,000 and a jury trial. Webb died June 22, 2025, after a physical confrontation at Clara Manor Nursing Home Inc., located at 3621 Warwick Blvd.

According to court records and police reports, the fight began around 2:45 a.m. in another resident’s room and continued into Webb’s room. Staff reportedly observed the altercation before Webb’s door closed. When employees attempted to enter, they found Webb’s body blocking the doorway. After gaining access, staff initiated CPR until emergency responders arrived. Webb was taken to a hospital, where he was pronounced dead.

The Jackson County Medical Examiner later ruled Webb’s death a homicide, with cardiac arrest during the physical altercation listed as the cause. The autopsy documented bruising to the face, scalp injuries, four fractured ribs and internal bleeding.

The other resident involved, identified in the lawsuit as Michael J. Wuellner, 57, was questioned by police at the scene but was not arrested, and no criminal charges had been filed as of the lawsuit’s filing.

Alleged Oversight Failures and History of Violations

The lawsuit asserts that Clara Manor failed to properly supervise residents, intervene in a known confrontation and ensure immediate emergency access. The family’s attorneys argue that adequate staffing, training and abuse-prevention protocols could have prevented the fatal escalation.

Court documents referenced in the suit show multiple federal safety violations at the facility between 2024 and 2025, including deficiencies tied to abuse prevention, staffing levels, supervision and emergency preparedness. A notice of noncompliance was issued by Missouri regulators in January 2025 but later cleared, despite continued deficiencies cited in subsequent surveys.

As of the latest filings, Clara Manor had not issued a public response to the lawsuit
