The family of a Seven Hills man has filed a wrongful death lawsuit against a Broadview Heights nursing home, alleging that neglect during a year-long stay led to his death.
According to the lawsuit, Charles Brush, 72, died on March 26, 2026, weeks after being transferred from Avenue at Broadview Heights Care and Rehabilitation Center to a hospital. The suit alleges Brush suffered from a drug-resistant fungal infection known as Candida auris that went untreated for months while he was a resident at the facility.
Family members say Brush was hospitalized in February 2026 after his condition sharply deteriorated. Medical records cited by attorneys reportedly show that he was septic, suffering from a urinary tract infection, pressure ulcers, hypothermia, and severe malnutrition.
The lawsuit alleges the nursing home knew or should have known about the infection and failed to provide appropriate medical care, monitor his condition, or notify family members of the seriousness of his illness.
Attorneys for the family state that Brush had tested positive for Candida auris nearly a year before his hospitalization but did not receive proper treatment while at the facility. The complaint alleges medical negligence and wrongful death.
At the time of publication, the nursing home and its parent company had not publicly responded to the allegations. Court records show the case was filed in Cuyahoga County in early January 2026.
The lawsuit adds to ongoing scrutiny of nursing home care standards in Ohio, where families have increasingly turned to the courts following resident injuries and deaths. No findings have yet been made in this case, and the allegations remain unproven.
