The U.S. Department of Health and Human Services has officially repealed most provisions of the federal nursing home staffing mandate, marking a significant policy shift for the skilled nursing sector. The repeal, announced in December 2025, eliminates the controversial requirements that would have mandated minimum staffing levels at nursing facilities nationwide.
The staffing mandate, originally finalized during the Biden administration, faced intense opposition from industry groups who argued the requirements were unrealistic given persistent workforce shortages. Legal challenges mounted throughout 2024 and 2025, with federal courts in Texas and Iowa issuing rulings that vacated key portions of the rule.
According to Skilled Nursing News, HHS withdrew its legal appeals in September 2025, effectively ending the federal government’s defense of the mandate. The repeal represents a major victory for nursing home operators who had warned that compliance would force facility closures in underserved areas.
Industry leaders cautiously welcomed the move while acknowledging that workforce challenges remain. Many providers continue to struggle with recruitment and retention, particularly in rural markets where the labor pool is limited.
The policy reversal shifts the focus back to state-level regulation of nursing home staffing. Several states have maintained or implemented their own minimum staffing requirements, creating a patchwork of standards across the country.
The repeal also removes the 24/7 registered nurse requirement and specific hourly staffing minimums that were central to the original mandate. CMS had previously sought to establish a minimum of 3.48 hours per resident per day of total staffing.
Looking ahead, providers expect the administration to pursue additional regulatory relief measures. CMS officials have indicated plans to reduce burden while maintaining quality and safety standards, though specific proposals remain under development.
